In this article, we present a model based on the creation of an activism index that lets us evaluate such activism's effect on the sensitivity of the investment policies of a company in the face of financial variables and market variables. Plagiarism is a serious, yet widespread type of research misconduct, and is often neglected in developing countries. Despite its far-reaching implications, plagiarism is poorly acknowledged and discussed in the academic setting, and insufficient evidence exists in Latin America and developing countries to inform the development of preventive strategies. In this context, we present a longitudinal case study of seven instances of plagiarism and cheating arising in four consecutive classes of an Epidemiology Masters program in Lima, Peru, and describes the implementation (...) and outcomes of a multifaceted, “zero-tolerance” policy aimed at introducing research integrity. Two cases involved cheating in graded assignments, and five cases correspond to plagiarism in the thesis protocol. Cases revealed poor awareness of high tolerance to plagiarism, poor academic performance, and widespread writing deficiencies, compensated with patchwriting and copy-pasting. Depending on the events’ severity, penalties included course failure and separation from the program. Students at fault did not engage in further plagiarism. Between 2011 and 2013, the Masters program sequentially introduced a preventive policy consisting of: intensified research integrity and scientific writing education, a stepwise, cumulative writing process; honor codes; active search for plagiarism in all academic products; and a “zero-tolerance” policy in response to documented cases. No cases were detected in 2014. In conclusion, plagiarism seems to be widespread in resource-limited settings and a greater response with educational and zero-tolerance components is needed to prevent it. (shrink)

Numerous eukaryotic DNA processing enzymes, such as DNA polymerases and ligases, bind the processivity factor PCNA, which acts as a platform to recruit and regulate the binding of enzymes to their DNA substrate. Multiple PCNA‐interacting motifs (PIPs) are present in these enzymes, but their individual structural and functional role has been a matter of debate. Recent cryo‐EM reconstructions of high‐fidelity DNA polymerase Pol δ (Pol δ), translesion synthesis DNA polymerase κ (Pol κ) and Ligase 1 (Lig1) bound to a DNA (...) substrate and PCNA demonstrate that the critical interaction with PCNA involves the internal PIP proximal to the catalytic domain. The ancillary PIPs, located in long disordered regions, are instead invisible in the reconstructions, and appear to function as flexible tethers when the enzymes fall off the DNA. In this review, we discuss the recent structural advancements and propose a functional hierarchy for the PIPs in Pol δ, Pol κ, and Lig1. (shrink)

Nature Network Groups hosted an invited workshop on 'Theories of Consciousness' during the second semester of 2009. There were presentations by each of 15 authors active in the field, followed by debate with other presenters and invitees. A week was allocated to each of the theories proposed; general discussion threads were also opened from time to time, as seemed appropriate. We offer here an account of the principal outcomes. Jewish law has a history stretching from the early period to the modern State of Israel, encompassing the Talmud, Geonic and later codifications, the Spanish Golden Age, medieval and modern responsa, the Holocaust and modern reforms. Fifteen distinct periods are separately studied in this volume, each one by a leading specialist, and the emphasis throughout is on the development of the institutions and sources of the law.

The distribution pattern of the meiotic machinery in known eukaryotes is most parsimoniously explained by the hypothesis that all eukaryotes are ancestrally sexual. However, this assumption is questioned by preliminary results, in culture conditions. These suggested that Acanthamoeba, an organism considered to be largely asexual, constitutively expresses meiosis genes nevertheless—at least in the lab. This apparent disconnect between the “meiosis toolkit” and sexual processes in Acanthamoeba led to the conclusion that the eukaryotic ancestor is asexual. In this review, the “meiosis (...) toolkit” is rigorously defended, drawing on numerous research articles. Additionally, the claim of constitutive meiotic gene expression is probed in Acanthamoeba via the same transcriptomics data. The results show that the expression of the meiotic machinery is not constitutive in Acanthamoeba as claimed before. Furthermore, it is argued that this would have no implications for understanding the nature of the eukaryotic ancestor, regardless of the result. (shrink)

Husserl on the Ego and its Eidos (Cartesian Meditations, IV) ALFREDO FERRARIN THE THEORY OF the intentionality of consciousness is essential for Husserl's philosophy, and in particular for his mature theory of the ego. But it runs into serious difficulties when it has to account for consciousness's transcendental constitution of its own reflective experience and its relation to immanent time. This intricate knot, the inseparability of time and constitution, is most visibly displayed in Husserl's writings from the 192os up (...) to the notion of the eidos ego in the fourth Cartesian Meditation. In this paper I want to dwell on the most problematic aspects of this theory. Husserl's Entwicklungsgeschichte on the topic of the pure ego has already been the object of important scholarly works, of which Kern's 1964 Husserl und Kant seems to me the best example. But what the secondary literature does not do is develop thematically the ambiguities of Husserl's definitions of consciousness and temporality in a unitary and comprehensive way. While I follow the lead of Berger, Broekman, Kern, Marbach,' and others, I find that their work does not sufficiently stress the difficulties at the core ofintentionality and reflective time- consciousness. Therefore, although section 2 is a necessary presupposition for drawing some critical conclusions in the final two sections, it does not exhaust my theme. After clarifying the peculiarity of the notions of essence, intuition, tran- scendental and apriori, as well as their irl:educibility to a Kantian meaning, I turn to the "de facto transcendental ego" resulting from eidetic variation (section 3) in order to introduce an examination of temporality. The difficul- ties in the twofold requirement, namely, that consciousness be the identical subject of its Erlebnisse and be synthetically unified in time, concern the unity, primacy, and mutual relation of time and consciousness in the constitution of our experience. They have been heady pointed out by Ricoeur in his commen- tary on the Cartesian Meditations. But what I want to argue in section 4, going beyond Ricoeur's text, is that the tension between temporally constituted and constitutive consciousness in the ego's reflection on its own retentions and protensions does not simply make the question of time ambiguous, but has crucial and problematic bearings on the very definition of consciousness as intentionality. This article seeks to take a step towards recognizing that science can deal with the concrete and individual as well as the universal. I shall concentrate on some of Aristotle’s texts, as there is a long tradition going back to Aristotle, according to which science deals only with the universal, although his work also contains texts of a very different tenor. He tries to improve the process of definition as an attempt to bring science closer to the concrete, but ends (...) up realizing that there are some unreachable limits. There is, however, a second Aristotelian approach to the problem in Metaphysica M 10, a passage which takes scientific rapprochement to the individual further by introducing a distinction between science in potential and science in act. The former is universal, but the latter deals with individual substances and processes. Aristotle himself acknowledges here that in one sense science is universal and in another it is not, a position that raises important ontological and epistemological problems. The importance of Adam Ferguson as part of the Scottish Enlightenment has been well established, with concentration on his social and political thought. George Turnbull has not been as well studied, but the valuable recent anthology by M. A. Stewart and Paul Wood has incited new interest. This paper selects a narrow aspect of their thought, their views on the social role of knowledge, which show common as well as complementary aspects. As educators who published their enhanced class notes, their (...) concern for providing positive motivations for their students is evident from their writings. Moral philosophy courses in general attempted to prepare graduates to assume responsible roles in society. Turnbull emphasizes the inspirational value of order and beauty in nature, while Ferguson's particular interest is in the value of learning efforts and knowledge development as part of the cumulative progress of civilization. We believe that a joint review of their thought can provide a rich source of possibly inspirational and motivational themes that could be helpful for professionals and educators in any culture. These topics are discussed here in the broader context of the Scottish Enlightenment. (shrink)

XIX español, el autor analizó los casos de importantes intelectuales como Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus y Nicolás Serrano. Con ello se cumplió parte del plan de desmontar la tesis frecuentemente aceptada de una "ausencia" de Vico en España. Este plan se viene a desarrollar ahora con una nueva aportación investigadora en la que el autor muestra y analiza (...) tres importantes casos más de recepción viquiana: la del ecléctico historiador Fermin Gonzalo Morón, la del renovador neoescolástico Ceferino González, y la del fundador de la escuela jurídica catalana Manuel Durán y Bas. Con ellos el autor confirma su tesis de que Vico es apreciado, tanto desde la recepción positiva como desde la crítica, como un pensador modemo y heterodoxo de considerable valía.In his former paper on Vico’s reception during the XIX century in Spain, the author reviewed such significant intellectuals as Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus and Nicolás Serrano. In so doing, the task of dislodging the thesis so frequently held that there is a Vico’s "absence" in Spain was partially accomplished. This task is taken up again in a recent investigation where the author analyzes and assesses three further important cases related with the Spanish Vichian reception: that of eclectic historian Femín Gonzalo Morón, the neo-scholastic Ceferino González and finally the Catalan legal school founder Manuel Durán y Bas. With those examples the author aims to validate his claim that Vico was indeed acknowledged both as a modern and heterodox thinker by the positive as well as by the critical reception. (shrink)

This study described the relationships between academic class and student moral sensitivity and reasoning and between curriculum design components for ethics education and student moral sensitivity and reasoning. The data were collected from freshman (n = 506) and senior students (n = 440) in eight baccalaureate nursing programs in South Korea by survey; the survey consisted of the Korean Moral Sensitivity Questionnaire and the Korean Defining Issues Test. The results showed that moral sensitivity scores in patient-oriented care and conflict were (...) higher in senior students than in freshman students. Furthermore, more hours of ethics content were associated with higher principled thinking scores of senior students. Nursing education in South Korea may have an impact on developing student moral sensitivity. Planned ethics content in nursing curricula is necessary to improve moral sensitivity and moral reasoning of students. (shrink)

Besides their skepticism about universal reason and universal morality, the Frankfurt Schools of Critical Systems Theory and Critical Theory share basic assumptions: (1) the thinking in societal-systemic, institutional concepts, which transcend simple reciprocal relations by dint of their complexity; (2) the assumption that society is based on fundamental paradoxes, antagonisms, antinomies; (3) the strategy to conceptualize justice as a contingent and transcendental formula; (4) the form of immanent (and not morality-based, external) critique as an attitude of transcendence; (5) the aim (...) of societal (and not only political) emancipation in an ‘association of free individuals’ (Marx). The article focuses on those parallels and aims to conceptualize a critical turn-around of autopoietic systems theory. (shrink)

La recepción europea de Gómez Dávila comenzó a desplegarse de manera más amplia a partir de la lectura y difusión realizada por Franco Volpi. Este artículo alude a la manera como dicha lectura concretó las interpretaciones del colombiano, principalmente a la luz de una filosofía práctica y una perspectiva crítica. De dichas posturas, el italiano destaca la vocación vital y el carácter provocador del pensamiento de Gómez Dávila.

Este artículo analiza en primera instancia la lectura y consideración hermenéutica que Ernesto Volkening realiza de la obra de Nicolás Gómez Dávila. Tras una presentación de las pautas interpretativas que se dan en el Diario de lectura de Volkening, se considera luego el interés de losautores por la arquitectura y el urbanismo modernos, como claves para la crítica del modo de vida reificante del hombre actual. Posteriormente, se ilustran las pautas que abordan la historia y la historicidad, bajo la idea (...) de una comprensión hermenéutica gestada en los contextos, opuesta a cualquier determinismo y puesta en marcha bajo la impronta de la singularidad e individualidad. As Heraclitus, Cioran conceives man as a being that possesses lógos and is ruled in his life by it in its multiple aspects. Man not only makes use of word; this word also shapes him and traverses him entirely. Word is the necessary and intrinsic expression of every human being, and, as a result, he cannot elude it. In many of his works, Cioran warns us about the dangers that lógos has for man: not to find his genuine expression in (...) the midst of so many words, and to fall into totalizing fictions that lead us to deception and indoctrination. For this reason, in the midst of this misfortune, Cioran even considers silence as the only possible way out. However, if man denies the mark of language by avoiding all forms of expression, the anguish that his own existence entails will end up destroying him. Paradoxically, Cioran finds that the expression of lógos is the only possible salvation for man from the clutches of death, and that is, why by expressing oneself through lógos, one's own unhappiness becomes a necessary condition of life. The article takes critiques of the entanglement of law with violence as a point of departure for exploring the possibility of a ‘tertium of law’. It thereby seeks to overcome the dichotomous basic assumptions that see law as always oscillating between an apology for violence on the one hand, and a utopia of reason on the other. The text analyses the possibility of this ‘tertium’, a ‘legal force’ beyond legal violence and legal reason, in four steps, drawing on the work (...) of Jacques Derrida and authors of the first generation of the Frankfurt School, in particular on Theodor Adorno and Walter Benjamin. It argues that in a first step law needs to be dissociated from the State. The violence of law, however, does not stem solely from law’s ties with State power. Law itself is violent even where it is not State law. The second step of legal critique thus needs to consist in the commemoration of legal violence, followed by a third that demands the transformation of violence to force. These three instances of critique are the precondition for a last and essential step according to which a critique of law must facilitate the transcendence of legal violence by taking law and its promise of justice at its word in order to turn this promise against law itself. Understanding the relationship of law and violence is one of the most important tasks for a postmodern critical legal theory. In his recent book Recht und Gewalt Christoph Menke explores the thesis that violence is not something external to law but an essential part of its constitution. While his concise analysis reveals the fundamental conflict of autonomy and societal responsivity of law, I suggest that we have to radicalize his concept in three ways. First, I propose to reconsider the belief (...) that law requires a polity . Second, I will argue that reflexivity of law needs to be conceived of as a process of fundamental democratization of law . Third, I propose that we not only need to depotentiate and displace the law, but that we have to transcend the law . For only transcending the law enables us to appeal to the utopian notion of a justice to come. (shrink)
